Is punitive damages allowed in any other SIRCUMSTANCES to avoid any breaches in contract ?
I thought the cookie Co is the one who breached the contract? it says they have a duty to mitigate to reduce the damages. seems like an obligation whereas the wording should have been they have the right to reduce damages. can anyone explain? are they the defendant in this case?
