Before writing the RFT and publication, the buyer and the project team need to run through 5 stringent and specific steps: Determine the kind of purchase. Estimate the contract value in collaboration with the internal project team. Choose the appropriate tendering procedure. Public authorities have the free choice between the Open and Restricted procedures. The Competitive Dialogue procedure and Negotiated procedure are exceptional procedures. Utilities have the free choice between the Open, Restricted and Negotiated procedures, but the Competitive Dialogue procedure is not available to them. The fourth and fifth step is about developing the selection and award criteria. The buyer and the project team need to: • Determine the kind of purchase. • Estimate the contract value. • Choose the appropriate tendering procedure. • Develop the selection criteria. • Develop the award criteria. Open Recommended in projects where: • Cost is very important. • Quality of materials is easily comparable. • Complexity is low and quotes submitted by suppliers are easy to compare. Restricted Recommended in projects where: • Quality of suppliers is important. • Complexity is high and comparison and evaluation of tenders is difficult and time consuming. Competitive Dialogue (Exceptional) Recommended in projects where: • Complexity is high. • Contracting authority is unable to determine the technical specifications and appropriate price level beforehand. Negotiated (Exceptional) Can only be used in projects where: • Other tendering procedures have not attracted acceptable tenders. • Received tenders quote an abnormally high cost. • Contract involves design contest. • Purchases involve utilities sector: utilities sector can freely use negotiated procedure with publication.
