Disputes arise naturally in modern legal systems. The main alternative or appropriate dispute resolution methods are mediation, conciliation, arbitration and judicial determination. These methods are known as ADR and are growing in popularity and encourage parties to resolve matters between themselves. The two main types of disputes are criminal and civil. The main institutions dealing with disputes are courts and tribunals. The reason why disputes occur in society is that disputes are inevitable. The law seeks to achieve just outcomes by establishing mechanisms to remedy disputes. Society demands disputes are settled in an orderly way and to avoid conflict. The traditional of resolving disputes was through the courts. Today alternative types of disputes resolution have been developed. The methods have progressed beyond the traditional court hierarchy and the adversary system of trial. Specialized courts and tribunals contribute to the efficient resolution of disputes by offering expertise in disputed areas, reducing delays and costs, and creating wider access to the legal system. The resolution of disputes is very important because if disputes are not resolved society is threatened and law and order could break down. Citizenship and democracy could be at risk.

The resolution of disputes is one of the most important roles performed by the law because if disputes are not resolved, social cohesion is threatened and breakdown of law and order may occur.
