Criminal post-trial procedures include the procedures used to determine an appropriate sanction. After the judge announced that the accused was found guilty he has to work out an appropriate sanction. Acts of Parliament provide guidelines for courts to choose the most appropriate sentence for the offender. The purpose of a sanction is to provide for: • just punishment • deterrence • rehabilitation • denunciation • community protection The main types of sanctions available today are in descending order: • Imprisonment • Combined custody and treatment order • Drug treatment order • Home detention • Intensive correction in the community • Suspended sentence • Youth justice center or youth residential center order • A community based order with or without recording a conviction • Fine, with or without recording a conviction • Release the offender adjourning the hearing and imposing conditions with or without recording a conviction • Discharge, dismissal or adjournment Sanctions are part of criminal procedures and contribute to an effective legal system in which criminals are punished for breaking the law.
