    The strengths of civil procedures can be evaluated with references to the elements of an effective legal system which are: • the entitlement to a fair and unbiased trial • the effective access to the legal system • the timely resolution to disputes In civil law an injured party has the right to sue for harm or loss caused by another. The person has the right to a fair and unbiased trial. Both parties are placed on an equal footing in the case due to pleadings an exchange of documents. The applications of the rules of evidence and procedures promote fairness. The use of precedents also promotes fairness and unbaisedness. The burden of proof lies with the plaintiff. The standard of proof is on the balances of probabilities. The careless party should redress the harm they have caused. There is a range of remedies for outcomes in a trial. There is an opportunity for an out of court settlement. An effective legal system allows access to the legal system. If not people could take the law into their own hands when dealing with civil disputes. The legal system provides a range of mechanisms for resolving disputes. Courts, tribunals and ADRs are willing to help. Expert advice is available. Appeals are allowed. Civil procedures regard the timely resolution of disputes as important. Delays are inefficient and lead to financial problems and stress. Computers can quicken the timely resolution of disputes. Other quickeners are out of court settlements, early clarification of issues, directional hearings and managed time limits. Supreme courts have a priority procedure for dealing with matters that are urgent, time consuming and complex.
