    Access means access to the mechanisms for disputes resolution. The mechanisms are the institutions and precesses that deal with the resolution of disputes. Most disputes are resolved outside the court hierarchy in a formal or informal manner.

    The law aims to achieve just outcomes when disputes occur. This is a good thing because sometimes disputes cannot be helped.

    The principles of access under effective laws refers to the mechanisms which constitute the framework for dispute resolution within the legal systems. Legal mechanisms are those institutions and processes used in the appropriate and just resolution of disputes, according to the law and principles of natural justice ( equality and fairness). The law aims to achieve just outcomes in disputes which are inevitable in society. That is, mechanisms for dispute resolution are required to minimise social disorder and division, and to avoid possible retaliation. The traditional mechanisms used for dispute resolution are the courts, ( Supreme court and Magistrates courts however, in the contemporary legal system more alternative types of dispute resolution mechanisms have been developed. Today, there are options for dispute resolution which progress beyond the traditional court hierarchy and adversarial system of justice. The society, as a whole, demand that disputes are to be settled peacefully, in a just and consistent manner.

    on the element of fairness is whereby a suspect standing a trial will be given a chance to inform his or her relatives about present legal status and have access to the right to legal representative also entitled to be kept in detention withn a limited period unless otherwise if arrangements are so made.

    As this element of fairness refers to legal processes which are which are not pre-judicial to persons involved, it should also be unbiased when getting to the conclusion made by a person listening to the case, various rights like; - certain restrictions on the power of arrest -Right to remain silent -Right to legal representative, to name a few should be considered.
