    In my first post I did relate to the behaviour of a party in not choosing to accept any further guidance from a practitioner (not in the case where the dispute later proves that there is now a need for litigation intervention). My concern was based on what human's negative emotions tend to do when there are disputes. It is now clearly seen that the legal framework is not enforcing litigation when there are disputes, unless they fall within certain categories eg. murder, certain repeated offenses like stealing at a highly structured level etc., however, it gives room as far as possible for out of court solution(s) within the confines of the ADR which has an umbrella under the legal dispute system. This I recognize will give parties enough time to become calm; think over the matter; remove any blind spots they may have had; see where he or she may have been at fault too, and rise to a solution that is for the common good not only for their own pursuits but for others, even those who do not know about the dispute. Some generation of transcending disputes would not have been around if they had been given early attention be it negotiation, mediation or arbitration.
